1. Acceptance of these Terms

These Terms of Service (the “Terms”) form a legally binding agreement between you and TonePilot Public Speaking Academy (“TonePilot”, “we”, “us”, “our”) and govern your access to and use of our website, courses, coaching sessions, and related services (collectively, the “Services”). By using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

2. Accounts

If you create an account, you agree to provide accurate, current information and to keep your login credentials secure. You are responsible for all activity that occurs under your account, whether or not authorized by you.

  • You must notify us promptly of any unauthorized access or suspected security breach.
  • We may suspend or terminate accounts that violate these Terms or pose a security risk.
  • You must be able to legally enter into contracts in your jurisdiction to use paid Services.

3. Services, Educational Nature, and No Guaranteed Outcomes

TonePilot provides educational content and coaching to help improve public speaking and communication skills. Individual results vary based on practice, experience, and circumstances. We do not guarantee any specific outcome (including performance, career advancement, or income).

4. Payments, Billing, and Taxes

Prices, features, and inclusions are displayed before checkout. By purchasing, you authorize us (and our payment providers) to charge your selected payment method for the applicable fees, including recurring charges when clearly disclosed.

  • Taxes: You are responsible for any applicable taxes unless stated otherwise at checkout.
  • Failed payments: If a payment fails, access to paid features may be paused until payment is resolved.
  • Promotions: Discounts are time-limited and may have eligibility restrictions.

For invoice corrections, provide your order email and the last 6 digits of the transaction reference to [email protected].

5. Cancellations and Refunds

Refund eligibility depends on what you purchased and how much of the content or service has been consumed. Unless a different policy is displayed at checkout, the following applies:

  • Courses and digital materials: Refund requests may be available within seven (7) days of purchase if the course has not been substantially consumed.
  • Coaching sessions: If you need to reschedule, request it at least 24 hours before the scheduled time. Missed sessions may be treated as delivered unless required otherwise by law.
  • Subscriptions: You may cancel future renewals at any time. Fees already paid are generally non-refundable except where required by law or expressly stated.

6. Acceptable Use

You agree to use the Services lawfully and respectfully. You must not misuse the Services or interfere with their operation.

  • No unlawful, fraudulent, or abusive behavior.
  • No harassment, hate speech, threats, or content that violates others’ rights.
  • No unauthorized sharing, resale, or redistribution of restricted materials.
  • No attempts to access non-public areas, bypass security, or probe vulnerabilities.
  • Respect privacy and intellectual property.

7. Intellectual Property

The Services, including text, audio, video, exercises, worksheets, and branding, are owned by TonePilot or licensed to us and are protected by intellectual property laws. You may access the content for personal, non-commercial use unless otherwise stated in writing.

You may not copy, reproduce, distribute, publicly display, create derivative works of, or exploit any part of the Services without prior written consent, except as permitted by law.

8. User Content

If you submit content (for example, speaking recordings, assignments, feedback, or messages), you represent that you have the rights to do so and that your content does not violate law or these Terms.

  • You retain ownership of your content.
  • You grant us a limited license to host, process, and display your content only to provide and improve the Services (including coaching feedback), unless you ask us to delete it where feasible.
  • We may remove content that violates these Terms.

9. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, TonePilot and its officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Where liability cannot be excluded, our liability will be limited to the amount you paid to us for the Services in the twelve (12) months preceding the event giving rise to the claim.

11. Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you violated these Terms, caused risk or harm, or used the Services unlawfully. You may stop using the Services at any time.

12. Changes to Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you by posting an updated version on this page and updating the “Last updated” date. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.
